Dans leur relation avec les états nations, les minorités ethniques vivent constamment sous la menace de divers empiétements de la société industrielle. La viabilité culturelle est intimement liée aux droits territoriaux et la lutte pour les faire reconnaître est devenue l'une des questions les plus importantes dans le développement ethno-politique. Le recours aux tribunaux est une stratégie utilisée dans ce contexte. Deux cas actuels tirés des Sami sont présentés pour illustrer l'argument général. Le cas de la Suède concerne les droits de principe et celui de la Norvège implique spécifiquement le développement hydro-électrique. L'auteur examine enfin les tribunaux comme arène d'activités ethnopoliliques. Selon lui, les tribunaux offrent des possibilités limitées sur le plan ethnopolitique, mais ce type de recours demeure un choix nécessaire.
Abstract:
In their relationship with the Nation States the ethnic minorities are living under constant threats of various encroachments caused by the industrial society. Cultural viability is intimately related to the land rights. For this reason struggle for improved land rights has become one of the leading political issues in the process of ethnopolitical development. Going to court is one strategy used in this context. To illustrate the general argument two current cases among the Sami are presented, one from Sweden dealing with land rights in principle, the other from Norway, which has to do with a specific case of hydro-electric development. Finally the author discusses the problem of the court as an arena for ethnopolitical activities. According to the author the court offers only restricted opportunities in ethnopolitical terms, but not going to court is currently no alternative.
